The drawings, illustrations, and artistic creations provided by LaLivery (hereinafter referred to as « the Artist ») are original works created for strictly artistic purposes. These creations are not intended to represent or reproduce logos, trademarks, or liveries in an official or technical capacity. Therefore, the drawings provided should not be considered as approved or endorsed designs by the trademark owners.

Ownership of Trademarks and Logos

All logos, trademarks, trade names, distinctive signs, and other intellectual property elements associated with airlines, aircraft manufacturers, or any other subjects depicted in the illustrations remain the sole property of their respective intellectual property holders. These elements are used in the Artist’s creations solely for aesthetic and artistic purposes and are not subject to any licensing, authorization, or approval by the intellectual property holders. The Artist does not claim any ownership rights over the trademarks or logos depicted in the created artworks.

Client’s Responsibility for Use of the Drawings

The Artist shall not be held liable for any use, reproduction, distribution, or exploitation of the drawings once delivered to the client. The client assumes full responsibility for the use of the drawings in any context, whether commercial, marketing, or otherwise. The client agrees to comply with applicable laws, particularly intellectual property laws, and to refrain from infringing upon the rights of the trademark or logo holders depicted in the creations. The Artist cannot be held responsible for legal consequences, including lawsuits for trademark infringement or copyright violations, resulting from the client’s use of the drawings.

Nature of the Drawings

The drawings created by the Artist are artistic works and not technical drawings or industrial design representations. Under Article L. 111-1 of the French Intellectual Property Code, these drawings are protected by copyright as original works. They do not carry any technical value and should not be interpreted as exact representations of airline liveries, industrial designs, or official brand representations. These works are intended solely for aesthetic and artistic purposes.

Modification or Adaptation of the Drawings

Any modification, alteration, or adaptation of the drawings created by the Artist must be done at the client’s sole responsibility. Under Article L. 121-1 of the French Intellectual Property Code, the Artist retains a moral right over the works, meaning that any modification must respect the integrity of the artwork. The client agrees to seek prior permission from the Artist for any substantial modifications to the drawings.

Transfer of Copyright

The transfer of copyright over the drawings created by the Artist is governed by the terms specified in the contracts or quotes established between the Artist and the client. In the case of a transfer, it applies exclusively to the artistic use of the works, within the limits and according to the conditions agreed upon by both parties. In the absence of specific mention, the copyright transfer does not grant the client any rights over the trademarks, logos, or other protected elements depicted in the illustrations. The Artist retains full copyright over the drawings, including the moral rights, unless otherwise agreed.

Limitation of Liability

The Artist disclaims all responsibility for the use of the drawings by the client, including any trademark infringement, copyright violations, or infringement of third-party intellectual property rights. The client is solely responsible for verifying that the use of the drawings complies with the relevant legislation, particularly regarding the necessary permissions for using trademarks or logos. The Artist cannot be held liable for any legal consequences arising from unauthorized or illegal use of the works by the client.

Disclaimer Regarding the Use of Protected Logos and Trademarks

The Artist strongly recommends that the client directly obtain permission from the intellectual property holders (owners of trademarks, logos, etc.) before any commercial, advertising, or other use of the drawings involving protected elements. The Artist disclaims any responsibility in the event of the drawings being used for purposes other than those specified in the contract or in the event that protected logos or trademarks are used without the permission of the rights holders.

By accepting the terms of this disclaimer, the client acknowledges that they have read and understood the limitations on the use of the drawings created and the responsibility they bear in complying with intellectual property laws. The client agrees to respect the integrity of the works, not to modify them without authorization, and not to use the drawings in ways that infringe upon third-party intellectual property rights.
